- Consider whether you should obtain a sworn independent valuation prior to engaging an agent. This will allow you to determine whether the agent’s estimate of the sale price of your propertyis realistic.
- The agent with the lowest commission is not always your best option.
- You must be clear on the legal meaning of all terms of your Agent Authority. Factors such as
a. how long is the agent‘s authority and what is the ‘Continuing Authority Period’,
b. when does your obligation to pay the agent’s commission end,
c. what are all the costs and commissions you are obliged to pay the agent (e.g. advertising, marketing)?
- Be careful accepting legal advice from your real estate agent about what you should or shouldn’t include in your sales contract.
